Closed Beta Agreement

This agreement is made between the user participating in the Borje closed beta program ("Participant") and the rights holder of the software, Borje (contact: borjeapp@gmail.com; "Licensor"). By checking the consent box on the beta application form and submitting it, you confirm that you have read and accepted this agreement.
1. License
Licensor grants Participant a limited, non-exclusive, non-transferable, non-sublicensable right to use the Software solely for personal evaluation and testing during the closed beta. This is a right to use; no ownership or intellectual property rights are transferred. The license is tied to a single account; accounts and installers must not be shared with third parties.
2. Prohibited actions
Participant agrees not to:
- Reverse engineer, decompile, or disassemble the Software, or otherwise attempt to derive its source code, internal architecture, or algorithms;
- Copy, reproduce, distribute, publish, rent, sell, or create derivative works of the Software;
- Share account credentials, installers, download links, or update channels with third parties;
- Circumvent, disable, or interfere with the Software's technical protection and authorization measures.
3. Confidentiality
All information Participant accesses through the closed beta — the Software's internals, architecture, features, performance data, roadmap, and any other non-public content — is confidential. Participant must not disclose it to third parties or make it public without Licensor's written consent. This obligation survives for 3 years after the beta program ends.
4. Intellectual property
The Software is protected as a work under applicable copyright law, including Turkish Law No. 5846 on Intellectual and Artistic Works. All economic and moral rights, source code, design, trademarks, and all other elements belong exclusively to Licensor. All rights not expressly granted here are reserved.
5. Feedback
Licensor may freely use any feedback, suggestions, and bug reports submitted by Participant during the beta to improve the product, without compensation and without time limit.
6. Beta nature and liability
The Software is under development and provided "as is"; no warranty of uninterrupted or error-free operation is given. Participant acknowledges that beta software inherently carries risks of data loss and instability and is responsible for backing up important data. Licensor's liability is limited to the maximum extent permitted by applicable law, except in cases of intent or gross negligence.
7. Termination
Licensor may suspend or terminate closed-beta access at any time without cause; access is revoked immediately upon breach of this agreement. Participant may leave the program at any time by requesting account deletion. Sections 2, 3, 4, and 5 survive termination.
8. Changes
Licensor may update this agreement; the current text is published on this page with a version label. Continued use of the Software after an update constitutes acceptance of the new version.
9. Governing law
This agreement is governed by the laws of the Republic of Türkiye. Turkish courts and enforcement offices have jurisdiction over disputes arising from it.
